Please read these competition rules carefully. They explain your legal rights and duties in this competition. They form a legal agreement between you and Killarney Mall (“the promoter”). Note: If you take part in this competition, or accept any prize, you agree that these rules will automatically apply to you and that Killarney Mall can assume that you have read, understood, and agreed to be legally bound by these rules. The Terms of this competition and Terms of Use will also apply to you.

 

1. HOW THIS COMPETITION WORKS

The promoter of this competition is Killarney Mall. In these rules, we refer to Killarney Mall as the promoter. We refer to participants and winners as “you”.

 

Killarney Mall is giving you the chance to win a variety of promotional items, vouchers and gifts when you spend R250 or more at Killarney Mall between 23 -26 November.

 

The competition runs from 25 - 26 November 2022. Killarney Mall winnings cannot be exchanged for their equivalent in cash.

 

Each entry is equivalent to one spin at the winning wheel.

 

Each person who enters will be given an opportunity to spin the wheel of winnings. The more times you enter the more you better your chances at winning the grand prize worth R2500.

 

To enter the competition, follow these instructions:

- Make a purchase of R250 or more at any store at Killarney Mall

- Complete an entry form available at the Campaign Activation Stand (please ensure all your details are correct, eg, phone number and email address)

- Attach your till slip to your entry as proof of purchase

- Drop it into the entry box provided at the Activation Stand or alternatively hand it into the promoter

 

Promotions are only valid during the period published by Killarney Mall.

 

Killarney Mall will notify the winner of the grand prize telephonically via the mobile number provided on your entry form and or via email to the address provided to us on your entry form.

 

Please note that by entering this competition you are agreeing and giving Killarney Mall permission to

add your contact details to their direct marketing database, and agree to receive communication from Killarney Mall.

 

The winner will be required to collect the gift voucher in person from Centre Management located at office 117 at the Killarney Mall office towers, with proof of identity.

 

Do not enter this competition if you do not wish to be photographed as the winner, or for your entry/photo to be shared on Killarney Mall’s social media pages or on a public platform.

 

The winner may be contacted to obtain more information about their entry

 

Killarney Mall reserves the right to extend or amend the competition. Notice of this will be posted in these rules.

 

2. WHO IS ELIGIBLE TO ENTER THE COMPETITION?

Any natural person with a valid South African ID, is eligible for an entry. All entries must be submitted via the entry boxes provided at the Information desk or in-store.

 

The following persons may not take part in the competition and will be disqualified. They will forfeit (give up) or refund any prizes awarded to them:

 

● Killarney Mall employees, advisors, board members, and consultants, and their

immediate family members.

 

● Any person that is involved in running or marketing this competition, or

awarding any prizes.

 

3. HOW WILL THE GRAND PRIZE WINNER BE CHOSEN AND NOTIFIED?

The winner will be randomly selected, with an auditor present. The winner will be notified by telephone or email. If the promoter is not able to get hold of you within 5 (five) days after making reasonable efforts to do so, or you do not claim your prize within 30 days from Killarney Mall located at 60 Riviera Road, Johannesburg, you will forfeit (lose) your prize and the promoter will then select a new winner.

 

4. GENERAL RULES THAT APPLY

If you fail to comply with any part of these rules you will be disqualified and you will give up (forfeit) any prize(s).

▪Unless the promoter says otherwise you must be at least 18 years of age to enter.

▪If you are under 18 years of age we will require permission from a parent or guardian before your entry will be deemed eligible.

▪Entries need to be submitted one at a time

▪Each slip to the value of R250 will be regarded as 1(one) entry.

▪Do not submit duplicate entries as an entry submission.

▪You are responsible for the tax associated with using or accepting any prize.

▪You may not attempt to do anything to change the outcome of the competition in any way.

▪The judges’ decision is final and no correspondence will be entered into. This means you cannot appeal any decision by the judges.

▪Please note that should you be selected and rewarded as the winner of this competition, you will be required to submit a legal and original form of identity before collecting your prize

▪You will also be required to collect the prize from the Killarney Mall premises at 60 Riviera Road, Killarney, Johannesburg

▪Killarney Mall will not be held responsible for any traveling costs incurred by you on the collection of your prize

▪The promoter has the right to end this competition at any time. If this happens you agree to waive (give up) any rights that you may have about this competition and agree that you will have no rights against the promoter.

▪The promoter reserves the right to change the rules of the competition. The promoter can change the rules of the competition throughout the competition. For convenience only, the date on which these rules were last amended will be shown below the heading. It is your responsibility to check the rules for amendments.

▪The promoter will use your data to enable your participation in this competition and related activities. The promoter will store and use your data according to applicable data protection laws and the Promoter’s privacy policy. By participating in the competition, you consent to the transfer, storage, and processing of your data. The promoter will keep your data to fulfill the purposes for which it was collected or as required by applicable laws. The Promoter will not use your data for a different purpose without first obtaining your consent.

▪The clauses in these rules are severable. This means that if any clause in these rules is found to be unlawful, it will be removed and the remaining clauses will still apply.

▪Where any dates or times need to be calculated in terms of this agreement, the international standard time: GMT plus two hours will be used.

▪While the promoter may allow you extra time to comply with your obligations or decide not to exercise some or all of your rights, or waive certain requirements, the promoter can still insist on the strict application of any or all of its rights at a later stage. You must not assume that this means that the rules have been changed or that it no longer applies to you.

▪This competition and its rules will be governed by the law of the Republic of South Africa regardless of where you live or work, or where or how you enter.

▪Upon entering, you agree to take part in publicity. You give the promoter and its affiliates the right, except where prohibited by law, to use your name to promote or publicize the competition, including the right to publish your name. Your name may also be announced on the promoter’s website and any other social media platforms used to promote the competition. The promoter retains the right to delay the timing of the publication of the winner of the competition.

▪You may not misuse the competition in any way.

▪You must comply with all the terms & conditions and privacy policies that apply to Killarney Mall.

▪You must obtain at your own expense all resources necessary to take part in this competition.

▪The promoter can put in place such technical or other remedies it considers appropriate to prevent abuse or to protect any website, wallet, systems, and other users.

▪The promoter shall not be liable to you for any disruption to the competition, because of technical or other problems, which is beyond its reasonable control. If there is a disruption to the competition the promoter will, where possible, take reasonable steps to fix any disruption and resume the competition on a fair and equitable basis to the entrants.

▪The promoter cannot accept any responsibility for entries not received for any reason, including, because they have been lost, or not received due to interrupted internet connections or miscommunications, or other electronic malfunctions.

▪Any fraudulent entries will be disqualified.

▪Killarney Mall Vouchers cannot be exchanged for their equivalent in cash.

 

IMPORTANT:

 

You agree to indemnify the promoter fully for any loss or damage the promoter may suffer because you breached the competition rules. This means you agree to reimburse the promoter for any loss or damage they suffer, any expenses, and costs they paid or are responsible for. Legal costs mean the costs of an attorney and their client scale.

 

You also agree to indemnify the promoter for any loss or damage you suffered because you took part in this competition or used the prize. If you submit your entry or use or accept the prize, you understand that you do so of your own free will. This means that you cannot hold the promoter legally responsible for any loss or damage or legal expenses you suffered because you took part in this competition.

 

You will protect the promoter from being held legally responsible for the loss or damage or legal expenses of another person (legal or natural) if such loss or damage or expense was incurred because you: a) breached the competition rules b) took part in this competition or c) any person used a prize.
