  • Under no circumstances can any aspect of this voucher be transferred to someone
    else, amended, extended, or exchanged for cash.
  • The cabin category is subject to availability at the time of booking on cruise
    departure dates within our low season.
  • The voucher is invalid for peak season, December, Theme, Grand Voyages, and South/Northbound positioning cruises.
  • The prize winner must be 18 years or older and all travellers must have a valid passport.
  • Please note, for the prize to be claimed, passenger details are to be provided, or the prize will be forfeited (passengers will not be able to board the ship without a cruise ticket)
  • This prize needs to be redeemed within 30 days calendar days after the winner has been announced.
  • This prize can not be exchanged for cash or any alternative

Please read these competition rules carefully. They explain your legal rights and duties about this competition. They form a legal agreement between you and Killarney Mall (“the promoter”). Note: If you take part in this competition, or accept any prize, you agree that these rules will automatically apply to you and that Killarney Mall can assume that you have read, understood, and agreed to be legally bound by these rules. The Terms of this competition and Terms of Use will also apply to you.

 

1. HOW THIS COMPETITION WORKS

 

The promoter of this competition is Killarney Mall and MSC Cruises. In these rules we refer to  Killarney Mall and MSC Cruises as the promoter. We refer to participants and winners as “you”.

Killarney Mall is giving you the chance to win A local 4-night cruise for 2 (two) onboard MSC Opera. Competition runs from 10 - 28 February 2025. 

Killarney Mall reserves the right to extend or amend the competition. Notice of this will be posted in these rules. Between 1 and 10 March Killarney Mall will select 1 winner from all eligible entries. The winner will be notified by Killarney Mall by calling the mobile number and or email address used when entering the competition. 

Please note that by entering this competition you are agreeing and giving  Killarney Mall permission to publish your entry submission on their social media platforms. Please note that by entering this competition you are agreeing and giving MSC Cruises permission to publish your entry submission on their social media platforms. 

Promotions are only valid during the period published by Killarney Mall, as per the below rules:

To enter the competition, follow these instructions: 

  1. Spend R250 or more at any Killarney Mall tenant

  2. Complete the entry form provided to you and attach your till slip to the entry form

  3. Place your entry form into the entry box located in the Woolworths court

  4. You may enter this competition multiple times

  5. Photocopied till slips will not be accepted as valid entries
  6. The winning entry will be featured on the Promoter’s platforms such as their website and  social media pages
  7. Do not enter this competition if you do not wish for your entry / photos to be shared on public platforms,  both online and in printed material
  8. The prize winner will be photographed at the time of receiving the prize from Killarney Mall

 

2. WHO IS ELIGIBLE TO ENTER THE COMPETITION?

Any natural person with a valid South African ID, is eligible for an entry. All entries must be submitted via the competition entry box located in the Woolworths Court. The following persons may not take part in the competition and will be disqualified. They will forfeit (give up) or refund any prizes awarded to them:

●   Killarney Mall or MSC Cruises employees, advisors, board members and consultants and their immediate family members.

●   Any person that is involved in running or marketing this competition, or awarding any prizes.

 

3. HOW WILL THE WINNER BE CHOSEN AND NOTIFIED?

The winner will be chosen at random from all entries. The winner will be notified by telephone or email. If the promoter is not able to get hold of you within 5 (five) days after making reasonable efforts to do so, or you do not claim your prize within 30 days from Killarney Mall located at 60 Riviera Road, Johannesburg, you will forfeit (lose) your prize and the promoter will then reward the prize to the runner up.

4. GENERAL RULES THAT APPLY

If you fail to comply with any part of these rules you will be disqualified and you will give up (forfeit) any prize(s).

▪ Unless the promoter says otherwise you must be at least 18 years of age to enter. 

▪  Please note that by entering this competition you are agreeing and giving the Rosebank Killarney Gazette permission to publish your entry submission on their social media and printed platforms. 

▪ You are responsible for the tax associated with using or accepting any prize.

▪ You may not attempt to do anything to change the outcome of the competition in any way.

▪ The judges’ decision is final and no correspondence will be entered into. This means you cannot appeal any decision by the judges.

▪   Please note that should you be selected and rewarded as the winner of this competition, you will be required to submit a legal and original form of identity before collecting your prize

▪   You will also be required to collect the prize from the Killarney Mall premises at 60 Riviera Road, Killarney, Johannesburg

▪   Killarney Mall will not be held responsible for any traveling costs incurred by you on collection of your prize

▪ The promoter has the right to end this competition at any time. If this happens you agree to waive (give up) any rights that you may have about this competition and agree that you will have no rights against the promoter.

▪ The promoter reserves the right to change the rules of the competition. The promoter can change the rules of the competition throughout the duration of the competition.  For convenience only, the date on which these rules were last amended will be shown below the heading. It is your responsibility to check the rules for amendments.

▪ The promoter will use your personal data to enable your participation in this competition and related activities. The promoter will store and use your personal data according to applicable data protection laws and the Promoter’s privacy policy. By participating in the competition, you consent to the transfer, storage and processing of your data. The promoter will keep your data to fulfil the purposes for which it was collected or as required by applicable laws. The Promoter will not use your data for a different purpose without first obtaining your consent.

▪ The clauses in these rules are severable. This means that if any clause in these rules is found to be unlawful, it will be removed and the remaining clauses will still apply.

▪ Where any dates or times need to be calculated in terms of this agreement, the international standard time: GMT plus two hours will be used.

▪ While the promoter may allow you extra time to comply with your obligations or decide not to exercise some or all of our rights, or waive certain requirements, the promoter can still insist on the strict application of any or all of its rights at a later stage. You must not assume that this means that the rules have been changed or that it no longer applies to you.

▪ This competition and its rules will be governed by the law of the Republic of South Africa regardless of where you live or work, or where or how you enter.

▪    Upon entering,  you agree to take part in publicity. You give the promoter and its affiliates the right, except where prohibited by law, to use your name to promote or publicise the competition, including the right to publish your name. Your name may also be announced on the promoter’s website and any other social media platforms used to promote the competition. The promoter retains the right to delay the timing of the publication of the winner of the competition.

▪    You may not misuse the competition in any way.

▪    You must comply with all the terms & conditions and privacy policies that apply to Killarney Mall.

▪    You must obtain at your own expense all resources necessary to enter the competition 

▪    The promoter can put in place such technical or other remedies it considers appropriate to prevent abuse, or to protect any website, wallet, our systems and other users.

▪    The promoter shall not be liable to you for any disruption to the competition, because of technical or other problems, which is beyond its reasonable control. If there is disruption to the competition the promoter will, where possible, take reasonable steps to fix any disruption and resume the competition on a fair and equitable basis to the entrants.

▪    The promoter cannot accept any responsibility for entries not received for any reason, including, because they have been lost, or not received due to interrupted internet connections or miscommunications, or other electronic malfunctions.

▪    Any fraudulent entries will be disqualified.

 

IMPORTANT:

You agree to indemnify the promoter fully for any loss or damage the promoter may suffer because you breached the competition rules. This means you agree to reimburse the promoter for the following: any loss or damage they suffer, any expenses and costs they paid or are responsible for. Legal costs means costs of an attorney and their own client scale.

You also agree to indemnify the promoter for any loss or damage you suffered because you took part in this competition or used the prize. If you submit your entry, or use or accept the prize, you understand that you do so of your own free will. This means that you cannot hold the promoter legally responsible for any loss or damage or legal expenses you suffered because you took part in this competition.

You will protect the promoter from being held legally responsible for the loss or damage or legal expenses of another person (legal or natural) if such loss or damage or expense was incurred because you: a) breached the competition rules b) took part in this competition or c) any person used a prize.
